What is an approved exporter?

An exporter who satisfies certain conditions imposed by the national customs authorities may apply for an authorization as an approved exporter for the purpose of making out origin declarations replacing the usual certificates. The customs authorities may grant the status of approved exporter subject to such conditions and procedures as they deem appropriate. The customs authorities shall monitor the use of the authorization by the approved exporter and may revoke it if the exporter makes improper or abusive use of it.

The figure of the authorized exporter is included in most of the preferential trade agreements signed by the European Union. Obtaining the status of Authorized Exporter allows the company to avoid the requirement to present the EUR1 in exports to countries with Free Trade Agreements with the E.U. (preferential tariff origin).

What requirements do I need to meet to become an approved exporter of origin? The requirements that need to be fulfilled in order to become an approved exporter for the purpose of origin are as follows:

1. Frequent exports (regularly performed) to countries with which the European Community has concluded Preferential Agreements providing for the possibility of the simplified approved exporter procedure.

2. That the products to be exported comply with the rules of origin and other requirements laid down in the relevant Preferential Agreement.

3. The customs or competent authorities shall make the grant of the concession subject to such conditions that they consider appropriate.

4. The exporter making out an invoice declaration shall be prepared to submit at any time, at the request of the customs authorities of the exporting country, all documents proving the originating status of the products as well as the fulfilment of the other requirements of the preferential agreements.

However, it should be noted that it is not always necessary to apply for an approved exporter to make the invoice declaration. All the origin regulations and protocols provide for the possibility for any exporter for any consignment consisting of one or more packages containing originating products up to a value not exceeding the specified amount provided for in each agreement (6,000 euros is the most common) to make the invoice declaration.
